Press release from Dovetail Games about F-16 release

Gents, Dovetail Games just send this press release. I copy it here so it is clear that the decision not to include liveries was not one we made. It's not a problem of course!

Dovetail Games is pleased to announce the release of Aerosoft’s F-16 Fighting Falcon on Steam. While we recognise that the inclusion of branded content is a very important aspect of the flight simulation experience, our policy at Dovetail Games is not to include any branded material without permission from the respective third parties. In this instance, we have been unable to secure permissions in time in order to offer the full range of liveries included within the original version of the F-16 Fighting Falcon. Our licensing team is currently working on negotiations with the respective third parties and we hope this will enable us to secure rights for future releases.

Aerosoft has confirmed that consumers may download the liveries and roundels included in the original version of Aerosoft’s F-16 from their site at this location: http://mirror-eu.aerosoft.com/fsx-steam-edition/

Now that is strange.

Dovetail does not include the liveries (exactly what is included then?) obviously because of legal reasons. They more or less state that the inclusion of liveries would not be legal. And then they ask Aerosoft to host these files AND directly link to the content that's not legal according to them in a official press release? Perhaps the press officer did not speak to their legal department because this is either a very strange move or a nasty mistake.

As I said, strange.

The release by Dovetails does not include the 61 liveries and 16 countries that we included. All liveries are replaced by a generic camouflage pattern. All the models etc are included of course.

And yes, to be perfectly honest we were also a bit surprised by the press release. But let's be 100% clear the content we include and Dovetail does not is in no way illegal or violating any rights. We have researched this extensively but under German law and European law. If we would do a product that was all about a one single Belgium F-16 we would for sure need to have permission, but is that same Belgium F-16 is one of 61 it is considered a minor part of the product and does not need any license. That's why we pay a license fee to General Dynamics, because the F-16 is a focus of the product.

So the file that we host is not in any way of form a violation of anybodies rights. That Dovetail links to it from their press release was surprising to us, but who are we to complain? Our point of view is that we should get the best possible product to the customer. And with this file they get EXACTLY the same product that we sell. Clearly Dovetail shared the idea that the customer should have the most complete product!

If you want to know more I suggest you talk to Dovetail because we are partners, but I cannot speak for them.
